These Terms govern your use of Pebble Oura Stats, a third-party watchface that connects to Oura's API to display health-related metrics on a Pebble smartwatch.
Pebble Oura Stats ("Application", "we", "us", or "our") is a third-party watchface that connects to Oura's API to display health-related metrics on a Pebble smartwatch. By installing or using the Application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Application.
You are granted a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a compatible device for your personal, non-commercial use. All rights not expressly granted remain with the developer.
You agree not to:
The Application depends on services provided by Oura, Pebble/Rebble, and possibly other third-party platforms. Your use of those services is subject to their own terms and privacy policies, and those providers may change, interrupt, or discontinue their services at any time. The developer of Pebble Oura Stats is not responsible for any actions, omissions, or policies of third-party providers.
The Application uses Oura's OAuth 2.0 flow for authentication. Your Oura credentials (such as your password) are handled only by Oura's own systems and are not accessible to the developer. You are responsible for maintaining the security of your Oura account and any device on which you use the Application. Any actions taken using your authorized access are your responsibility.
Data handling is described in the Pebble Oura Stats Privacy Policy, which is incorporated by reference into these Terms:
By using the Application, you consent to the collection and use of information as described in the Privacy Policy.
The Application is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express, implied, or statutory.
Without limiting the above, the developer does not guarantee that:
The Application is not a medical device and is not intended to provide medical advice, diagnosis, or treatment. Any health-related information shown via the Application is sourced from Oura and is for general informational purposes only. Always consult a qualified healthcare professional for questions about your health.
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunities; damages related to reliance on data displayed by the Application; or damages resulting from interruptions, errors, security breaches, or other failures.
If liability cannot be fully excluded, the total cumulative liability of the developer related to the Application shall not exceed the total amount (if any) paid by you to use the Application in the twelve (12) months prior to the event giving rise to the claim.
You agree to indemnify and hold harmless the developer, and any related parties, from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Application, your violation of these Terms, or your violation of any applicable law or third-party rights.
The developer may suspend or terminate your access to the Application at any time, with or without notice, for any reason, including if there is suspicion of misuse or violation of these Terms. You may stop using the Application at any time by uninstalling it and revoking Oura access.
Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will continue to apply after termination.
The Application may be updated, modified, or discontinued at any time. Features may change or be removed without notice. The developer is not liable for any impact such changes may have on you or your usage.
These Terms may be updated periodically. The "Last Updated" date at the top of this page indicates when they were last revised. Continued use of the Application after changes are published means you accept the updated Terms.
These Terms are governed by the laws applicable in the jurisdiction where the developer is based, without regard to conflict-of-law principles. Any disputes arising from or related to these Terms or the Application shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless applicable law requires otherwise.
Severability: If any provision of these Terms is found invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the Application.
No Waiver: Any failure by the developer to enforce a right or provision in these Terms shall not constitute a waiver of that right or provision.
Open Source Components: The Application may incorporate open source libraries or components governed by their respective licenses, which may be referenced in the project's GitHub repository: github.com/arturojreal/pebble-oura-stats. If there is any conflict between an open source license and these Terms for a particular component, the open source license will govern for that component.
